What Must Be Reported as an Accident?

The North Carolina Wildlife Resources Commission reported 154 accidents in 2009, 21 of which resulted in fatalities. The majority of accidents occurred between the months of April and August, with operator inattention ranked as the number one cause. Since some accidents on the water result in minimal damage, not all collisions warrant a report. However, the North Carolina Wildlife Resources Commission does require that more serious incidents are reported.

In North Carolina, accidents must be reported if they involve:

  • Loss of life
  • Loss of consciousness
  • Medical treatment
  • Disability for more than 24 hours
  • Property damage in excess of $2000
  • Disappearances from a vessel under circumstances that indicate death or injury

How to Move Forward Following an Accident

Once someone is hurt or killed in a boating accident, a number of factors must be considered. First, know who was at fault. This often requires familiarity with boating regulation and, in some cases, maritime law. Second, identify how much insurance coverage is needed, if any. It may be necessary to inquire about the existence of any umbrella coverage or personal assets of the “at fault” party. Finally, determine whether the actions of the at-fault party will be considered “willful and wanton” conduct, and will warrant punitive damages.
