Charlotte Boating Accident Attorneys

Decades of Protecting the Health and Safety of Our Clients

With over 300 miles of coastline and many large lakes scattered throughout, the State of North Carolina has become a popular destination for people who enjoy boating. Unfortunately, as more and more people take to the waterways, more accidents occur. Inexperienced operators, alcohol, and the rapid growth of personal watercraft can all contribute to the problem. The boating accident attorneys at Price, Petho & Anderson in Charlotte have experience helping clients secure compensation for medical care and other damages resulting from accidents on the water.

If you have suffered a serious injury from a boating accident, call (704) 350-2630 for a free consultation about your case.

What Must Be Reported as an Accident?

The North Carolina Wildlife Resources Commission reported 154 accidents in 2009, 21 of which resulted in fatalities. The majority of accidents occurred between the months of April and August, with operator inattention ranked as the number one cause. Since some accidents on the water result in minimal damage, not all collisions warrant a report. However, the North Carolina Wildlife Resources Commission does require that more serious incidents are reported.

In North Carolina, accidents must be reported if they involve:

  • Loss of life
  • Loss of consciousness
  • Medical treatment
  • Disability for more than 24 hours
  • Property damage in excess of $2000
  • Disappearances from a vessel under circumstances that indicate death or injury

How to Move Forward Following an Accident

Once someone is hurt or killed in a boating accident, a number of factors must be considered. First, know who was at fault. This often requires familiarity with boating regulation and, in some cases, maritime law. Second, identify how much insurance coverage is needed, if any. It may be necessary to inquire about the existence of any umbrella coverage or personal assets of the “at fault” party. Finally, determine whether the actions of the at-fault party will be considered “willful and wanton” conduct, and will warrant punitive damages.

Since 1979, the team at Price, Petho & Anderson has provided aggressive representation of people injured in marine accidents of all types. Our team consists of experienced attorneys in matters of boating, including a former member of the United States Coast Guard.
